Probate Administration

Trust Administration

Trust Administration is similar to probate administration in terms of gathering and managing assets, except it refers to the gathering, management and distribution of assets in a trust. Unlike probate, trust administration is not typically a court-supervised process. While a Trustee is not required to file or open a trust case, per se, Florida law does require that the Trustee comply with the Florida Trust Code, which provides specific guidelines and requirements for how trusts are managed and administered within Florida.


While Trustees are not required to hire an attorney, Trustees are expected to comply with very specific requirements governed by the Florida Trust Code. It is helpful for Trustees to consult with, and hire, an attorney to ensure compliance with Florida laws. Lohmiller Law, PLLC, can assist Trustees in this process.

Wrongful Death Probate

Tragically, sometimes families lose a loved one as a result of the negligence of another person, or a company. When the family files a wrongful death lawsuit, an estate is required to be opened. This is because only a court-appointed Personal Representative of the deceased person's estate has the authority to sue on behalf of the deceased person.
